TeleDakter Terms and Conditions

These Terms and Conditions ("Terms") form a legal agreement between you ("you," "your") and TeleDakter, governing your access to and use of our websites, web-based platforms, and mobile applications (collectively, the "Platforms"). By using our Platforms, you agree to be bound by these Terms and our Privacy Policy.

If you do not agree with these Terms, you must stop using the Platforms immediately.

1. Use of TeleDakter Services

TeleDakter provides telehealth services and facilitates your access to licensed medical professionals through secure Platforms. TeleDakter does not provide insurance, fulfill prescriptions, or act as a pharmacy. Medical services are delivered independently by healthcare providers; TeleDakter is not responsible for their clinical decisions or actions.

2. Modifications to Terms

TeleDakter reserves the right to modify these Terms at any time without prior notice. Updates will be effective as of the revised "Effective Date" listed above and will be posted on our Platforms. Continued use after changes constitutes your acceptance.

3. Account Access and Security

To access our services, you must create an account and safeguard your login credentials. You are responsible for all activity under your account. Notify us immediately at privacy@teledakter.com if you suspect unauthorized use.

4. Eligibility and Representations

By using our Platforms, you represent that:

You are at least 18 years of age or the legal guardian of a minor using the service
All registration information you provide is accurate and complete
You will use the Platforms only in compliance with all applicable laws
You are not accessing services for fraudulent, harmful, or unlawful purposes

5. Termination of Use

TeleDakter may terminate or restrict your access at any time without notice if you violate these Terms. Upon termination, you must immediately stop using the Platforms. Certain provisions, such as limitations on liability and indemnification, will survive termination.

6. Prohibited Activities

You agree not to:

Transmit unlawful, harmful, or unsolicited material
Impersonate others or misrepresent your identity
Attempt unauthorized access to systems or data
Interfere with system operations or security features
Use bots or automated tools to overload the system
Engage in spam, phishing, or distribution of viruses

7. SMS Communications

8. Intellectual Property

All content on the Platforms, including logos, software, and materials, are the property of TeleDakter. You may not copy, modify, or distribute any content without prior written consent. By submitting feedback, you grant us the right to use it without obligation or compensation.

TeleDakter may link to third-party websites for convenience. We are not responsible for their content or accuracy. Use of third-party sites is at your own risk and subject to their terms.

10. No Endorsements

Reference to third-party services or views expressed by third parties does not constitute endorsement by TeleDakter.

11. Indemnification

You agree to indemnify and hold harmless TeleDakter and its affiliates from any claims, losses, or damages arising from your use of the Platforms, violation of these Terms, or misuse of services.

12. Limitation of Liability

To the fullest extent permitted by law, TeleDakter is not liable for any indirect, incidental, or consequential damages, including loss of profits or data, arising from your use of the Platforms or services.

13. Disclaimer

The Platforms are provided "as is" without warranties of any kind. TeleDakter does not guarantee uninterrupted access or that the Platforms will be free of errors or security vulnerabilities.

14. Children’s Use

Our Platforms are not intended for children under 13 years old. We do not knowingly collect personal data from minors without parental consent.

15. Governing Law

These Terms are governed by the laws of the State of Delaware. Any disputes will be resolved exclusively in the courts located in Delaware.

16. Privacy

Your use of the Platforms is also governed by our Privacy Policy. We collect and use your personal information in accordance with applicable privacy laws.

17. Waiver

No failure to enforce any part of these Terms shall be considered a waiver of our rights.
